1. Introduction

These Warranty Terms and Conditions govern the warranty cover provided on ATN branded products distributed in Australia by Winchester Australia Limited (ABN 50 004 645 318). By purchasing an ATN product through an authorised Australian dealer, the customer agrees to be bound by these Warranty Terms and Conditions.

2. Definitions

"We", "Us", "Our" refers to Winchester Australia Limited, the authorised Australian distributor of ATN products.

"You", "Customer" refers to the original purchaser of an ATN product from an authorised Australian dealer.

"ATN" refers to ATN Corp and its affiliated manufacturing entities.

"Products" refers to ATN thermal imaging devices, digital day and night vision scopes, monoculars, binoculars, rangefinders, batteries and related accessories supplied by Winchester Australia Limited.

"Authorised Dealer" refers to a retailer appointed by Winchester Australia Limited to sell ATN products in Australia.

3. Warranty Cover and Period

Under normal use and maintenance, Winchester Australia Limited warrants ATN products against defects in materials and workmanship for the periods set out below, calculated from the original date of purchase as shown on the customer's tax invoice.

4. Start of Warranty Period

Warranty commences on the date of purchase shown on the customer's tax invoice from an authorised Australian dealer.

Where a valid tax invoice cannot be produced, the warranty period will be calculated from the date the product was shipped from Winchester Australia Limited to the dealer.

5. What is Covered

The warranty covers repair or, at our discretion, replacement of any ATN product found, on inspection by Winchester Australia Limited or its authorised service partner, to be defective in materials or workmanship under normal use during the applicable warranty period.

6. What is Not Covered

The warranty does not cover:

(a) damage caused by misuse, abuse, neglect, accidents, drops, liquid spills or improper voltage input;

(b) damage caused by impact, fire, lightning strikes, flooding, natural disasters or other force majeure events;

(c) damage resulting from use outside the product's published operating specifications or failure to follow the user manual for operation, maintenance or storage;

(d) products that have been modified, disassembled or repaired by any party not authorised by Winchester Australia Limited or ATN;

(e) products on which the serial number, nameplate or barcode has been removed, defaced or rendered unreadable;

(f) consumable items and components with a limited useful life, including but not limited to batteries beyond their stated warranty period, eye cups, lens caps and protective covers;

(g) cosmetic damage, scratches, dents and normal wear and tear;

(h) damage occurring during transport by the customer or any third party not engaged by Winchester Australia Limited;

(i) special order, clearance or "as-is" merchandise sold on that basis;

(j) loss of, or damage to, any data, settings or third-party content stored on the product.

7. Claim Process

Step 1: Return the product to the authorised Australian dealer of purchase with proof of purchase and a written description of the fault. Where possible, include photographs or video showing the issue.

Step 2: The dealer will make an initial assessment of these warranty terms. Where the dealer cannot resolve the claim, the dealer will lodge the claim with Winchester Australia Limited on the customer's behalf.

Step 3: Winchester Australia Limited will assess the claim and, where the product is determined to be eligible, will arrange repair, replacement or, where neither is reasonably practicable, a refund in line with the customer's rights under the Australian Consumer Law.

Step 4: Assessed warranty turnaround is targeted at 30 days from receipt of the product at Winchester Australia Limited, subject to parts availability and any required referral to ATN.

8. Proof of Purchase

A valid Australian tax invoice from an authorised dealer is required for all warranty claims. Winchester Australia Limited reserves the right to decline claims where proof of purchase cannot be provided.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits provided by this warranty are in addition to other rights and remedies available to you under the Australian Consumer Law.

10. Limitation of Liability

To the extent permitted by law, Winchester Australia Limited is not liable for any indirect, incidental, special or consequential loss or damage arising from the use of, or inability to use, any ATN product, including but not limited to loss of profits, loss of opportunity, loss of data or property damage. Where liability cannot be excluded, our liability is limited, at our option, to the repair or replacement of the product, or the cost of repairing or replacing the product.

11. Geographic Scope

This warranty applies only to ATN products purchased from authorised Australian dealers and used within Australia. Products purchased overseas or through unauthorised channels are not covered by this warranty.

12. Changes to These Terms

Winchester Australia Limited reserves the right to update or amend these Warranty Terms and Conditions at any time. The current version at the time of purchase will apply to that purchase.
